  1. Acceptance of Terms

These Terms and Conditions of Service ("Terms and Conditions of Service") form a legally binding agreement between you ("User", "you") and Tapwego ("we", "us", "our") governing your use of the Tapwego, also known as Tapwego Technologies LLC application (“App”) and Website and any related services (the "Platform").

By downloading, accessing, or using the Tapwego mobile application ("App") or website ("Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, then you may not use our services.

2. Description of Service

Tapwego is a technology platform that connects passengers ("Riders") with independent transportation providers ("Drivers") to facilitate ridesharing services. We do not provide transportation services directly but act as a marketplace connecting users.

3. Eligibility and Account Requirements

3.1 General Eligibility

You must be at least 18 years old to create an account

You must provide accurate, current, and complete information

You are responsible for maintaining the security of your account

3.2 Driver Requirements

Valid driver's license and appropriate commercial insurance

Vehicle meeting our safety and quality standards

Successful completion of background check and vehicle inspection

Compliance with all local licensing and regulatory requirements

3.3 Rider Requirements

Valid payment method on file

Compliance with community guidelines and local laws

4. User Conduct and Prohibited Activities

4.1 Prohibited Conduct

You agree not to:

Use the service for illegal activities or to transport illegal substances

Harass, abuse, or harm other users

Discriminate against others based on protected characteristics

Damage or tamper with vehicles or property

Use false identity or impersonate others

Attempt to circumvent safety features or payment systems

4.2 Content Guidelines

No inappropriate, offensive, or harmful content in messages or profiles

Respect the privacy of other users

No spam, commercial solicitation, or unauthorized advertising

5. Payment Terms

5.1 Pricing

Fares are calculated based on time, distance, and demand

Dynamic pricing may apply during high-demand periods

All applicable taxes and fees will be clearly displayed

5.2 Payment Processing

Payment is processed automatically through your selected payment method

You authorize us to charge your payment method for all services

Refunds are subject to our refund policy

5.3 Driver Payments

Drivers receive payment minus our service fee

Payments are processed weekly to the driver’s accounts

Drivers are responsible for their own tax obligations

6. Safety and Insurance

6.1 Safety Measures

All drivers undergo background checks

Vehicles are subject to safety inspections

GPS tracking is enabled during rides

 In-app emergency features are available

6.2 Insurance Coverage

Commercial insurance coverage applies during active rides

Coverage details vary by location and local regulations

Users should review their personal insurance policies

6.3 Seat Belts

All drivers, riders, delivery drivers and everyone in the backseat should put on seat belts/ buckle up. If a vehicle doesn’t have enough seat belts for everyone in a ride request, the driver may decline the request. Riders and their guests should request a ride that has enough seat belts for everyone.

 

 6.4 Helmets for Motorcycles, bicycles and scooters

To ensure that you are safe, when riding a motorcycle, bicycle or scooter please you must wear a suitable buckled helmet according to the instructions provided by the manufacturer.

 

6.5 Regular Vehicle Maintenance and Upkeep

 Every driver and delivery driver are expected to regularly maintain and to keep their vehicles in good working condition. All maintenance should be done in accordance with the set industry safety maintenance standards. Keep track of any repairs and recalls needed from the vehicle manufacturer.

 

6.6 Safe, Careful Driving and Accident Free

We expect drivers and delivery drivers to be very circumspect and maintain a safe environment when driving. Driver or delivery driver can lose access to part or the whole of Tapwego platform, if it is reported that a driver or delivery driver is driving in a dangerous manner.

 

6.7 Video and/or Audio Recording

   Dashcams or phones may be placed in the vehicle by Drivers and delivery drivers to record rides. To provide law enforcement, local authorities or insurance companies’ evidence when there is an incident.

             Important Notes

  • It is a violation of our community guidelines to stream or share someone’s image or audio/video recordings on social media, public locations or other digital media which can lead to investigations by Tapwego safety team.
  • Please check your local laws and regulations to find out your responsibilities. Because some local laws and regulations in certain areas require people to be notified or consent to any recording.
  • Recordings may be submitted to Tapwego at their discretion. As part of investigations Tapwego may also request the recordings to take appropriate action.

 

6.8 Emergency

Commercial insurance coverage applies during active rides

Coverage details vary by location and local regulations

Users should review their personal insurance policies

Please alert emergency services or your local authorities before letting Tapwego know if you run into immediate danger.

Riders, drivers and delivery drivers have access to the emergency button available in the app, whilst on the app any safety incident can be reported or ride location and information can be shared with friends, family, loved ones and law enforcement.

7. Cancellation and Refund Policy

7.1 Ride Cancellations

Riders may cancel rides within the free cancellation window

Cancellation fees may apply after the free cancellation period

Drivers may cancel rides for safety or other valid reasons

7.2 Refunds

Refunds are provided for service failures or billing errors

Refund requests must be submitted within 30 days

Refunds are processed to the original payment method

8. Privacy and Data Protection

8.1 Data Collection

We collect necessary information to provide our services

Location data is collected during rides for safety and navigation

Personal information is protected according to our Privacy Policy

8.2 Data Sharing

Limited data sharing with drivers and riders to facilitate rides

Data may be shared with third parties as outlined in our Privacy Policy

We do not sell personal information to third parties

9. Intellectual Property

9.1 Our Rights

 The App, Platform, and all related content are the intellectual property of Tapwego Technologies LLC. Users receive a limited license to use our services. Any non-expressive rights that are not granted herein are reserved by Tapwego and Tapwego licensors.

 No rights are granted beyond those explicitly stated.

9.2 Restrictions

  • Technology and Algorithms: The underlying technology powering the apps - including matching algorithms, pricing models, and mapping systems, images and animations remains exclusively owned by Tapwego.
  • Derivative Works: Drivers, delivery drivers and users are prohibited from creating derivative works based on the platform's technology or copying functionality for competing services.
  • Brand and Trademark Usage: Any use of Tapwego trademarks, logos, or brand elements without permission is not allowed. Any unauthorized use can result in account termination.

         Users of the platform are prohibited from attempting to gain unauthorized access to harm the operations and/or functionality of Tapwego services, its related systems and networks.

9.3 User Content

You retain rights to content you create

You grant us a license to use content as necessary to provide services

You represent that you have rights to any content you share

10. Limitation of Liability

10.1 Service Disclaimer

Services are provided "as is" without warranties

We do not guarantee availability, accuracy, or reliability

We are not liable for actions of drivers or riders

10.2 Liability Limits

Our liability is limited to the maximum extent permitted by law

We are not liable for indirect, incidental, or consequential damages

Total liability will not exceed the fees paid in the preceding 12 months

11. Indemnification

You agree to indemnify and hold us harmless from claims arising from:

Your use of our services

Your violation of these Terms

Your violation of applicable laws or regulations

Your infringement of third-party rights

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the applicable country or state without regard to conflict of law principles.

12.2 Arbitration

Disputes will be resolved through binding arbitration

Arbitration will be conducted under [Arbitration Rules]

Class action lawsuits are waived

13. Termination

13.1 Termination Rights

Either party may terminate the agreement at any time

We may suspend or terminate accounts for violations

Termination does not affect accrued rights and obligations

13.2 Effect of Termination

Access to services will cease immediately

Outstanding payments remain due

Provisions that should survive will continue to apply

14. Modifications to Terms

14.1 Updates

We may modify these Terms at any time

Material changes will be communicated through the App or email

Continued use constitutes acceptance of modified Terms

14.2 Notification

Users will be notified of significant changes

30-day notice will be provided for material modifications

Users may terminate if they disagree with changes

15. General Provisions

15.1 Entire Agreement

These Terms constitute the entire agreement between the parties.

15.2 Severability

If any provision is found invalid, the remainder remains in effect.

 

15.3 Assignment

We may assign these Terms; users may not assign without consent.

15.4 Force Majeure

Neither party is liable for delays caused by circumstances beyond reasonable control.
